DMCA & Intellectual-Property Policy

1 Overview

PlayUp Hosting (“Company”, “we”, “our”) respects the intellectual-property rights of others and expects users of our services (“you”) to do the same.  We operate a zero-tolerance policy toward the sale, distribution, or hosting of infringing content.

2 Repeat-Infringer Policy

We will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

3 Submitting a DMCA Notice (Copyright Owners)

If you believe that material accessible on or from our service infringes your copyright, please send a written notice that includes all of the following:

  1. Identification of the copyrighted work you claim is infringed (or a list of multiple works).

  2. Identification of the material you believe is infringing, with enough detail (URL, video ID, time-stamp) to locate it.

  3. A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.

  4. A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

  5. Your physical or electronic signature.

  6. Your contact information – name, address, telephone, and valid email.

4 Counter-Notification (Users)

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification containing:

  1. Identification of the material that has been removed or disabled and the location where it appeared before removal.

  2. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.

  3. Your name, address, telephone, and email, plus a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Travis County, TX if outside the USA) and that you will accept service of process from the party that filed the original DMCA notice.

  4. Your physical or electronic signature.

5 Procedure After Receipt

  • Upon receiving a valid DMCA notice, we will expeditiously remove or disable access to the identified material and notify the affected user.

  • If we receive a valid counter-notification, we will forward it to the original complainant.  Unless the complainant files an action seeking a court order within ten business days, we may restore the material.

6 Trademarks & Other IP

For trademark or other IP concerns, email support@playuphosting.com with (a) a description of the rights you own, (b) the allegedly infringing material, and (c) evidence of your ownership.

7 Misrepresentation

Under 17 U.S.C. §512(f), anyone who knowingly misrepresents that material is infringing or was removed by mistake may be liable for damages, including costs and attorney’s fees.

8 Policy Updates

We may update this policy from time to time.  Changes become effective when posted on this page.
